BnB Flow — Terms of Service (Leads & Site Users)

Effective date: August 1, 2025

These Terms of Service (“Terms”) govern your use of BnB Flow’s websites, forms, alerts, and related Services as a prospective buyer/investor or site visitor. By using the Services, you agree to these Terms.

If you are a real-estate professional purchasing leads, see the BnB Flow Agent Terms (separate agreement).

1) About BnB Flow

BnB Flow operates a lead marketplace that introduces STR-interested buyers to independent, licensed real-estate agents who purchase those leads. BnB Flow is not a real-estate broker, lender, escrow, or legal/financial advisor. We do not represent buyers in transactions and do not guarantee property outcomes, returns, or agent performance.

2) Eligibility & accuracy

You must be at least 18 and provide accurate, current information. You are responsible for the content you submit and for keeping your contact data current.

3) Matching & disclosures

  • When you submit interest in a market/property and consent to contact, we may match you to one or more paying, vetted agents. If an agent purchases your lead, we will disclose your contact details and form responses to that agent (and, if applicable, their brokerage).

  • BnB Flow does not control how an independent agent contacts you or what advice they provide. Work with agents at your own discretion.

4) Communications consent

By submitting your information, you authorize BnB Flow and purchasing agents to contact you via email, phone, and SMS about your inquiry. Message & data rates may apply. You can opt out at any time by using unsubscribe links, replying to any message to request stop, or emailing [email protected]. Consent is not required to use our Services.

5) No advice; independent decisions

Information provided through BnB Flow is general and may include third-party content. It is not legal, tax, or financial advice. Always conduct your own due diligence and consult qualified professionals.

6) User conduct

You agree not to: (i) submit false, misleading, or unlawful information; (ii) harass or abuse BnB Flow staff or partner agents; (iii) interfere with or reverse-engineer the Services; (iv) use the Services for competitive scraping or to build a lead list.

7) Intellectual property

The Services and all related content are owned by BnB Flow or its licensors and are protected by IP laws. You are granted a limited, non-exclusive, revocable right to access and use the Services.

8) Disclaimers; limitation of liability

THE SERVICES ARE PROVIDED “AS IS.” BNBFLOW DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BNBFLOW DOES NOT WARRANT ANY PARTICULAR LEAD AVAILABILITY, MATCHES, OR AGENT RESULTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BNBFLOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. IN NO EVENT WILL BNBFLOW’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES EXCEED $100 IN THE AGGREGATE. THE FOREGOING LIMITATIONS WILL NOT APPLY TO LIABILITY RESULTING FROM BNBFLOW’S FRAUD, WILLFUL MISCONDUCT, OR VIOLATION OF APPLICABLE LAW.

Some states do not allow certain limitations; in that case we limit liability to the smallest amount permitted.

9) Indemnity

You agree to defend, indemnify, and hold harmless BnB Flow from claims arising out of your misuse of the Services or violation of these Terms.

10) Changes; termination

We may modify or discontinue the Services or these Terms at any time. We may suspend or terminate your access for any breach or misuse.

11) Governing law; disputes

Governing law. These Terms are governed by the laws of the State of North Carolina, excluding its conflict-of-laws rules. The Federal Arbitration Act (“FAA”) governs the interpretation and enforcement of the arbitration agreement below.

Arbitration & class-action waiver. Except for the matters carved out below, you and BnB Flow agree to resolve any dispute, claim, or controversy arising out of or relating to the Services or these Terms (“Dispute”) by binding individual arbitration administered by AAA under its Consumer Arbitration Rules (or JAMS Consumer Rules, if AAA is unavailable).

  • Location / format. The arbitration will take place in your county of residence (or mailing address) or by phone/video at your election.

  • Fees. AAA/JAMS consumer fee schedules apply. We’ll pay any filing or administrative fees that the applicable rules require us to pay.

  • Relief / authority. The arbitrator may award individual relief that would be available in court. No class, consolidated, private attorney general, or representative actions are permitted.

  • Small claims court. Either party may bring an individual claim in small-claims court in your county of residence (or Mecklenburg County, NC) instead of arbitration.

  • Injunctive/IP carve-out. Either party may seek temporary or preliminary injunctive relief or protection of intellectual-property or platform abuse in state or federal court in Mecklenburg County, North Carolina.

  • Opt-out. You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your full name and email address.

Venue if arbitration is inapplicable. If a Dispute is filed in court (only as permitted above), state or federal courts in Mecklenburg County, North Carolina have exclusive jurisdiction and venue, and the parties consent to personal jurisdiction there.

Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim must proceed in court (not arbitration); if any other part of this section is unenforceable, the remainder still applies.
